It depends entirely on the composition of the jury and both sides plus the judge have a say on who is actually qualified to sit on it.

He can also request a bench trial and dispense with taking the risk of some woke SJW agitators sneaking onto the jury. Then it will be the prosecution who has the upward struggle persuading the judge.

He is entitled to due process and mitigating circumstances must be taken into consideration and that's assuming any other charges stick in the first place.
