You only have to pay a couple hundred bucks in fines (per employee), if you are a first time offender. If you've done it before, it can be several thousands and a few months in prison. In practice, no one ever goes to prison, and instead the prosecution almost always offers a settlement.
As long as the punishments amount to a slap on the wrist, the lure of hiring illegals is gonna be too strong.
In many areas - like construction or agriculture - it's almost impossible to NOT HIRE illegals.
I mean... if you get a loan straight from the local construction union (conditional on hiring their guys), and the city grants you some kind of amazing tax credit - then you can go and "Build American".
Also, if your berry farm is right next to a college campus - you can hire the hippie college students to pick your strawberries for you. Maybe kids from a local middle school can be rotated in and out on field trips - as a stopgap measure.
College students and middle schoolers are pretty much the only group of Americans which can compete with illegal immigrants when it comes to seasonal berry picking.
When it comes to middle schoolers, however, there's a whole gamut of annoying child labor regulations that must be navigated. They also need frequent breaks and can eat the entire value of their pickings in peanut butter and jelly sandwiches.
