While Phelps was finally protected by 1st Amendment, the entire legal process take about 4 years, and most of that time church property was under court liens to assure that awarded $5M damages will be paid. Also, there was considerable financial expenses.

Similar condition may be fatal for a private person, who can find yourself out of control of their own property and with zero credit. Especially if motivated opponent will "optimise" their actions for a maximal damages.

Rich, prison is not always worst thing that can occur with the human being. ;) Read again - I meant that in EU you are risk to get just some prison term or fine. In US you are not risking to be sentenced DUE to your speech. But highly motivated opponent may use other ways to make your mouth shut, if you cause them problems, with options to ruin your family business and reputation, for example. And, if done carefully, the same 1st amendment may make them immune against your legal attempts to stop this.

Concerning persons who was prosecuted for speech - I do not know anyone who was prosecuted by government, but know a couple of guys who had problems due to conflicts based on "corporate speech code" violation. One of them just noted that new HR manager (recently immigrated from India) hire unproportionally high percentage of Indians for a open vacances, and most of new employees have skills lower than expected. Accused in discriminatory harassment and later fired (4 or 5 yrs ago)...
