Pure nonsense as it would require that I read the a-hole's mind at 2 am in my own house. Quoting:
In each case the following conditions must exist to justify the use of force:
There was imminent danger or threat to you, someone else, or your property;
The threat was unlawful;
You believed that a danger existed that required force; and
You used force that was equal to the threat.That 2 am visit meets all of the above without them saying a word and on my assumption alone that they came to commit ALL of these offenses - including murder to eliminate a witness, me. I am not required to ask, are you going to just have a coke or are you going to kill me when you are done sipping.
That is why in a civilized country like the US we have the stand your ground laws and presume that the owner has a right to defend himself without ANY need to assess what the intruders want.
Same while walking in the park at 10 pm. From that website:
deadly force is also allowed to prevent a forcible felony such as:
Sexual assault
Battery
Murder
Robbery
ArsonWhen three black teenage thugs walk up to a couple at 10 pm and demand a wallet from the guy, that's all he needs to fire.
While waiting for the definition of "adequate"...
A while back I called the Naperville police department and asked what my lawful responses to a home invasion are. Without any hesitation, buts and howevers, they said, fire but not the perp's back while he is near the door. Then, call us.
That's it.
